Terms of Service

These Terms of Service ("Terms") govern your access to and use of maindcontrol.ai and related services (the "Service"), operated by TMHC BUILDING ENGINEERING CONSULTING - FZCO ("mAIndControl", "we", "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

mAIndControl is a business tool that extracts structured tasks, follow-ups, and decisions from email files (.msg / .eml) you upload, using automated and AI-assisted processing. Output is provided for your convenience and may contain errors; you remain responsible for reviewing it before relying on it.

2. Accounts

• You must provide a valid email address and authenticate via one-time codes.
• You are responsible for activity under your account and for keeping access to your email secure.
• You must be at least 16 years old and authorized to act on behalf of any organization you represent.

3. Acceptable use

You agree not to:

• upload content you have no right to process or share;
• use the Service to violate any law or third-party right;
• attempt to breach security, bypass quotas or rate limits, reverse-engineer, or disrupt the Service;
• resell or provide the Service to third parties except as expressly permitted.

You are solely responsible for the lawfulness of the email content you upload, including obtaining any necessary consent from the individuals whose data appears in it.

4. Plans, trial, and billing

• The Service offers a free trial with limited usage, then a paid subscription.
• Subscriptions are billed in advance on a recurring basis through our payment processor (Stripe) at the price shown at checkout. Applicable taxes may apply.
• Prices may change; we will give notice of changes affecting your renewal.
• Cancellation: you may cancel at any time; access continues until the end of the current billing period. Upon expiry or cancellation, your account reverts to free-trial limits.
• Refunds: except where required by law, payments are non-refundable.

5. Your content

• You retain all rights to the files and data you upload ("Your Content").
• You grant us a limited license to process Your Content solely to operate and provide the Service (including transmission to our AI sub-processor for extraction, as described in our Privacy Policy).
• We do not claim ownership of Your Content and do not use it to train AI models.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by TMHC BUILDING ENGINEERING CONSULTING - FZCO and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

7. Service availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue features at any time.

8. Disclaimer of warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Extracted output is automated and not professional advice; you are responsible for verifying it.

9. Limitation of liability

To the maximum extent permitted by law, TMHC BUILDING ENGINEERING CONSULTING - FZCO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless TMHC BUILDING ENGINEERING CONSULTING - FZCO from any claim arising out of your use of the Service, Your Content, or your breach of these Terms.

11. Termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk or legal exposure. You may stop using the Service at any time.

12. Governing law

These Terms are governed by the laws of the Emirate of Dubai, United Arab Emirates, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, unless mandatory consumer law provides otherwise.

13. Changes to these Terms

We may update these Terms. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
